Description
This article is an examination of the Building and Construction Industry Security of Payments Act 1999 (NSW) and, to a lesser extent, its equivalents in other State legislatures as a case study of alternative dispute resolution’s ability to adapt to specialised industry needs. The article begins with an examination of the context into which the legislation was introduced and the failure of traditional legal systems to address various industry-specific problems. Then, comparing the legislation with its Western Australian equivalent, the article examines some of the goals and efficacy of the model. Finally, the article examines some of the pitfalls associated with the model, especially as it is encoded in state-level legislation and some possible solutions to these problems.
